Personal data is collected, processed, and stored by the data controller, KECOTEH O\u00dc, registration code 10275175, located in Abjaku, Mulgi Parish, Viljandi County (hereinafter referred to as the data processor).<\/p>\n\n<p>1.2 A data subject within the meaning of the data protection terms is a customer or any other natural person whose personal data is processed by the data processor. A customer within the meaning of the data protection terms is anyone who purchases goods or services from the data processor&#8217;s website. <\/p>\n\n<p>1.3 By placing an order in the data processor&#8217;s online store, the data subject agrees to these data protection terms by checking the corresponding box in the order process.<\/p>\n\n<p>1.4 The data processor follows the principles of data processing established by law, including processing personal data lawfully, fairly, and securely. The data processor is able to confirm that personal data has been processed in accordance with legal requirements. <\/p>\n\n<p>1.5 Personal data collected, processed, and stored by the data processor is collected electronically, primarily through the submission of orders on the website and via email. The personal data entered by the data subject when placing an order is entered into the customer register and used to fulfill the sales contract and offer products to the data subject. <\/p>\n\n<p>1.6 By sharing their personal data, the data subject grants the data processor the right to collect, organize, use, and manage the personal data that the data subject shares directly or indirectly with the data processor when purchasing goods or services on the website for the purposes defined in the data protection terms.<\/p>\n\n<p>1.7 The data subject is responsible for ensuring that the data provided by them is accurate, correct, and complete. Knowingly providing false information is considered a violation of the data protection terms. The data subject is obliged to immediately inform the data processor of any changes to the submitted data.  <\/p>\n\n<p>1.8 The data processor is not liable for any damage caused to the data subject or third parties due to the submission of false information by the data subject.<\/p>\n\n<p>2. Processing and Storage of Customer Personal Data<\/p>\n\n<p>2.1 The data processor processes the following personal data of the data subject:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>&#8211; first and last name;<\/li>\n\n\n\n<li>&#8211; phone number;<\/li>\n\n\n\n<li>&#8211; email address;<\/li>\n\n\n\n<li>&#8211; delivery address;<\/li>\n\n\n\n<li>&#8211; payment method;<\/li>\n\n\n\n<li>&#8211; bank account number;<\/li>\n\n\n\n<li>&#8211; purchase history.<\/li>\n<\/ul>\n\n<p>When visiting the website shop.treest.eu, the page automatically saves the following data: browser identifier, page visit frequency, average time spent on the page, and products viewed.<\/p>\n\n<p>2.2 Legal Basis for Processing Personal Data<\/p>\n\n<p>Personal data is processed for the purpose of fulfilling the contract concluded with the customer (management of customer orders, delivery, return of goods and payments).<\/p>\n\n<p>Personal data is processed to fulfill a legal obligation (e.g., accounting).<\/p>\n\n<p>The processing of personal data is necessary for the legitimate interest of the controller, which consists of collecting purchase history data for the purpose of resolving potential consumer disputes.<\/p>\n\n<p>2.3 Purpose<\/p>\n\n<p>Personal data is used to manage customer orders and deliver goods.<\/p>\n\n<p>Purchase history data (date of purchase, goods, quantity, customer details) is used to compile overviews of purchased goods and services and to analyze customer preferences.<\/p>\n\n<p>The bank account number is used to issue refunds to the customer.<\/p>\n\n<p>Personal data such as email, phone number, and customer name are processed to resolve issues related to the provision of goods and services (customer support).<\/p>\n\n<p>The email address is used to send newsletters or collect information about product quality if the customer has given their consent.<\/p>\n\n<p>Data such as browser identifier, page visit frequency, average time spent on the page, and products viewed are used to improve the content and functionality of the website.<\/p>\n\n<p>2.4 Retention<\/p>\n\n<p>The data processor retains the data of data subjects depending on the purpose of the processing.<\/p>\n\n<p>Upon closing an online store customer account, personal data is deleted, unless such data needs to be retained for accounting purposes or for resolving consumer disputes.<\/p>\n\n<p>If a purchase in the online store is made without a customer account, the purchase history is retained for three months.<\/p>\n\n<p>In the event of disputes related to payments and consumer disputes, personal data is retained until the claim is fulfilled or the limitation period expires.<\/p>\n\n<p>Personal data required for accounting purposes is retained for seven years.<\/p>\n\n<p>2.5 Recipients to Whom Personal Data is Transferred<\/p>\n\n<p>The data processor has the right to share customers&#8217; personal data with third parties, such as online store customer support, authorized data processors, accountants, transport and courier companies, product manufacturers, and companies providing transfer services.<\/p>\n\n<p>The data processor undertakes not to transfer customers&#8217; personal data to unauthorized third parties, unless the obligation to transfer personal data arises from the law.<\/p>\n\n<p>Personal data is transferred to the online store&#8217;s customer support for managing purchases and purchase history and for resolving customer issues.<\/p>\n\n<p>The name, phone number, email address, and customer address are transferred to the courier for the delivery of goods.<\/p>\n\n<p>If the online store&#8217;s accounting is performed by a service provider, personal data is transferred to the service provider for accounting operations.<\/p>\n\n<p>Personal data may be transferred to information technology service providers if necessary to ensure the functionality of the online store or data hosting.<\/p>\n\n<p>By posting feedback and photos, the buyer agrees that they may be published on Treest&#8217;s social networks.<\/p>\n\n<p>To evaluate the quality of purchased products, the customer may be contacted via email after the order has been delivered. The customer is asked to leave a product review and rate the purchased goods. To fulfill this purpose, the buyer&#8217;s email address may be transferred to third parties.  <\/p>\n\n<p>If the customer has subscribed to the Treest newsletter and provided their email address, it may be transferred to third parties.<\/p>\n\n<p>2.6 &#8220;Treest&#8221; is the Processor of Your Personal Data<\/p>\n\n<p>Treest is the processor of your personal data, and we are responsible for ensuring that your personal data is processed properly and in accordance with current European Union\/European Economic Area legislation.<\/p>\n\n<p>2.7 When processing and storing the personal data of the data subject, the data processor implements organizational and technical measures that ensure the protection of personal data against accidental or unlawful destruction, alteration, disclosure, and any other unlawful processing.<\/p>\n\n<p>The transfer of personal data to authorized processors of the online store (e.g., courier and data hosting) takes place on the basis of contracts concluded between the online store and the authorized processors. Authorized processors are required to ensure appropriate safeguards when processing personal data in accordance with Article 28 of the General Data Protection Regulation. <\/p>\n\n<p>2.8 Personal data is stored on OVH servers located in the territory of a European Union member state or countries that have joined the European Economic Area. Data may be transferred to countries whose level of data protection has been assessed as adequate by the European Commission or to a company in a third country to which a safeguard measure referred to in Article 46 of the General Data Protection Regulation has been applied. <\/p>\n\n<p>Access to personal data is granted to online store employees who can access the personal data to resolve technical issues related to the use of the online store and to provide customer support services.<\/p>\n\n<p>The online store implements appropriate physical, organizational, and information technology security measures to protect personal data from accidental or unlawful destruction, loss, alteration, or unauthorized access and disclosure, which include: data exchange with the e-shop takes place via an encrypted connection (TLS), customer passwords are stored in encrypted form (hashes), standard encryption is used when sending emails, a firewall and appropriate antivirus software are implemented to protect the e-shop servers, and regular backups are created and stored separately from the e-shop server.<\/p>\n\n<p>Rights of the Data Subject<\/p>\n\n<p>3.1 Access and Correction of Personal Data<\/p>\n\n<p>Personal data can be accessed and corrections made in the online store user profile or through customer support. If a purchase was made without a user account, personal data can be accessed through customer support. <\/p>\n\n<p>The data subject has the right to receive information about the processing of their personal data. The data subject has the right to supplement or correct inaccurate data. <\/p>\n\n<p>The customer has the right to request the correction of incorrect, incomplete, and inaccurate personal data by email by sending their request to info@treest.eu.<\/p>\n\n<p>The request for correction will be answered no later than within 30 days.<\/p>\n\n<p>3.2 Withdrawal of Consent<\/p>\n\n<p>If the processing of personal data is based on the customer&#8217;s consent, the customer has the right to withdraw consent under the user account settings or by notifying customer support via email at info@treest.eu.<\/p>\n\n<p>3.3 Restriction<\/p>\n\n<p>The customer has the right to request the restriction of the processing of their personal data if the data is incorrect or incomplete, or if their personal data is processed unlawfully.<\/p>\n\n<p>3.4 Objections<\/p>\n\n<p>The customer has the right to object to the processing of their personal data if they have reason to believe that there is no legal basis for processing their personal data. If personal data is processed for direct marketing purposes (profiling), the customer has the right to object at any time to both the initial and further processing of their personal data, including profiling related to direct marketing, by notifying customer support via email at info@treest.eu. <\/p>\n\n<p>3.5 Deletion<\/p>\n\n<p>To delete personal data, you must contact customer support via email (info@treest.eu). The deletion request will be answered no later than within 30 days, and the period for data deletion will be specified. The response to the request will also highlight the personal data that will not be deleted and on what legal basis and for what reason.  <\/p>\n\n<p>3.6 Portability<\/p>\n\n<p>The data subject has the right to request the transfer of personal data. A request for the transfer of personal data submitted via email will be answered within one month at the latest. Customer support will verify the identity and inform about the personal data subject to transfer.  <\/p>\n\n<p>3.7 Dispute Resolution<\/p>\n\n<p>Disputes related to the processing of personal data are resolved through customer support.
